Terms of Use Preamble & Scope
These Terms of Use apply to the entire content of this online service (hereinafter referred to as the “Community” or “Service”) and govern the relationship between the users (hereinafter referred to as “Users”) and the operator of this online service. Any agreements deviating from these Terms between the operator and the User shall only become effective if made in text form (e.g. e-mail or support ticket).
1. Content of the Online Service & Disclaimer of Liability- Registration and the use of the basic functions on this platform are free of charge.
- The operator assumes no liability whatsoever for the timeliness, accuracy, completeness, or quality of the information provided. Liability claims against the operator relating to material or non-material damages caused by the use or non-use of the information presented or by the use of incorrect or incomplete information are generally excluded, unless the operator can be proven to have acted with intent or gross negligence.
- All offers are non-binding and subject to change. The operator expressly reserves the right to modify, supplement, delete, or temporarily or permanently discontinue parts of the pages or the entire service without prior notice.
- Minimum Age: The minimum age for registration and use of this Community is 18 years. Registrations by persons below this minimum age are prohibited. If the operator becomes aware of underage use, the corresponding account will be deleted immediately and without prior notice.
- Obligation to Provide Truthful Information: All information provided by the User during registration or while using the service must be truthful without exception. This applies in particular to identity and contact information (e-mail address). In the event of false information, any claim to support shall immediately expire.
- Account Usage & Multiple Profiles: Each User may only create one private account. Usage is restricted exclusively to natural persons. Commercial use for personal benefit or on behalf of third parties is strictly prohibited. The use of third-party accounts (unauthorized account usage) is also prohibited. Multiple profiles (e.g. secondary accounts or additional or inactive side profiles) are not permitted and will be deleted after review by the operator.
- Verification: The operator may offer user verification (so-called FakeCheck) or request it at any time in the event of justified suspicion of a false identity or untruthful information. The verification procedure shall be determined solely by the operator; the User has no claim to the implementation of such a procedure. A previously granted FakeCheck status may be revoked by the operator at any time without stating reasons.

Sanctions and House Rules: In the event of violations of these Terms of Use or applicable law, the operator reserves the right to impose appropriate sanctions within the scope of its virtual house rules. These include:
- The temporary suspension of the account.
- The permanent deletion of the account.
- An indefinite virtual ban from the platform (denial of future access to this and other services operated by the operator).
- Loss of Rights in Case of Misconduct: If an account is deleted by the operator due to misconduct by the User, all rights acquired by the User within the Community (e.g. the administration of groups) shall simultaneously expire.
- A free account is valid for an indefinite period of time. It may be terminated and deleted by either the User or the operator at any time without observing a notice period. There is no entitlement to the continued maintenance of a free account.
- After the deletion of the account, the User’s data and content will be deleted, provided that no statutory retention obligations prevent such deletion.
- In the event of deletion due to serious violations of the Terms of Use, there shall be no entitlement to restoration of the account.
- The operator and its administrators shall not provide any information about other accounts to third parties (including friends or acquaintances of Users).
- Further information regarding the processing of personal data can be found in the separate Privacy Policy of the service.
- Support requests from suspended or deleted Users regarding their own account will only be answered if they are formulated objectively and verification is carried out via the registration e-mail address stored in the system.
- If a User persistently attempts, despite prior warning, to obtain information about third-party accounts, this may result in the immediate suspension of their own account.
- Functionalities: The Community is subject to continuous development. The operator is entitled to adapt, modify, or remove the design, functions, and scope of individual features without prior notice or the User’s consent. The core functions (profile, basic communication methods) shall remain available within the limits of technical feasibility.
- Localization Services (Maps): The operator offers optional localization services (for determining fixed or mobile location data). These services are disabled by default and must be activated by the User through an active action (opt-in). By activating these services, the User agrees to the processing of the resulting location data for the purpose of providing the service.
- Personal Responsibility: The User bears full legal responsibility for all content published by them (profile texts, comments, images, videos, etc.). The User shall ensure that their content does not infringe any third-party rights (in particular copyrights, trademark rights, or personal rights). The User shall indemnify and hold the operator harmless from all claims asserted by third parties on the basis of the User’s content, including the costs of reasonable legal defense.

Prohibited Content: The following content is strictly prohibited:
- Copyright-protected texts (e.g. song lyrics) or media without the appropriate license.
- Content or symbols glorifying violence, racist, discriminatory, extremist, or unconstitutional content.
- Pornographic content outside the limits permitted by law, as well as any form of child, youth, or animal pornography (including ambiguous or drawn depictions).
- Harassment, stalking, insults (offensive or defamatory content), or targeted defamation against other Users or the operator.
- The publication of telephone numbers or the placement of commercial/business contact advertisements.
- The deliberate advertising of third-party platforms or competing communities.
- Groups: Users may create interest groups (starting from 3 members). The group administrator bears full responsibility for the content published on the group wall and must prevent disputes or defamatory accusations against named persons. The operator reserves the right to delete groups with fewer than 3 members after an appropriate period of time or to immediately delete “hate” or defamatory groups. There is no entitlement to the deletion of existing groups after the founder leaves; the operator shall decide on the future existence of such groups.
- Right of Review and Modification: The operator reserves the right, at its own dutiful discretion, to shorten, edit, or completely delete content that violates these guidelines. Repeated posting of objectionable content shall result in the immediate suspension of the account.
- Copyright of the Operator: All content, programs, scripts (e.g. JavaScript files), graphics, and trademarks provided by the operator are protected by the operator’s copyright. The use of program components or logos without explicit permission is prohibited.
- Usage Rights to User Media: The User grants the operator a non-exclusive right of use to the uploaded images and media for the duration of the account’s existence, limited to the display within this website or directly embedded services. No separate commercial exploitation by the operator shall take place. Private images remain within the User’s private sphere. Upon deletion of the account, this right of use expires and the media will be deleted from the system.
The User has the option to activate or deactivate the subscription to the newsletter sent via e-mail at any time within the account settings.
10. Contractual Penalties in Cases of Abuse (Spam & Deception)- Spam and Advertising Prohibition: The User is prohibited from sending mass messages consisting of identical or advertising content (spam/bulk messages). This applies in particular to messages referring to paid premium-rate services, subscription traps, mobile phone numbers, or external commercial offers, as well as messages pretending to be official system notifications from the operator.
- Contractual Penalty for Commercial Abuse: In the event of an intentional, serious, and commercial violation of the spam prohibition, the operator reserves the right to assert an appropriate contractual penalty. The amount of the contractual penalty shall depend on the nature, scope, and impact of the violation. The assertion of further damages (e.g. investigation costs, legal fees, or compensation for processing User complaints) shall remain unaffected.
- Deception Regarding Administrative Status: If a User falsely claims to possess administrative rights or special functions (pretending to be an administrator or support staff member), the operator shall be entitled to terminate and delete the account without notice.
- Premium and Sponsor Subscription: Paid memberships are offered as Premium or Sponsor subscriptions with different durations (monthly, quarterly, or yearly terms). Billing is processed via the payment service provider PayCific.
- No Automatic Renewal & Subscription Term: The subscriptions do not renew automatically after the booked subscription period expires. Therefore, cancellation is not required; the status automatically expires at the end of the contractual term. The User may manually renew or repurchase the membership afterwards if desired.
- Prices & Currency: All prices are stated in Euro (EUR). If payment is made from a foreign currency area, the amount will be converted into the respective currency by PayCific.
- Refunds: In the event of a justified suspension or deletion of the account due to a serious violation of these Terms of Use, as well as in the event of premature voluntary deletion of the account by the User, all pro-rata claims arising from the current Premium or Sponsor subscription shall expire; partial refunds are excluded. The statutory right of withdrawal shall be governed by the Terms and Conditions of the payment provider PayCific.
- Right of Withdrawal for Digital Services: The User expressly agrees that digital services may begin immediately after activation of the Premium or Sponsor status. Upon commencement of the digital service, the statutory right of withdrawal may expire prematurely, insofar as legally permissible.
- The User may not object to these Terms of Use in part, as the contractual relationship shall only come into existence upon full acceptance of the Terms. A subsequent partial objection (e.g. within a profile text) entitles the operator to immediately terminate the user agreement without notice and to delete the profile.
- Should individual provisions of these Terms of Use be or become invalid, the validity of the remaining provisions shall remain unaffected. The statutory provisions shall apply in place of the invalid provision.
